„können die militiirisch gerechtfertigten Anordnungen der Kriegsge
walt nicht aus dem Grunde als ungültig angefochten werden, dass sie
der Verfassung oder dem Landesrecht widersprechen."
Militcirische Bedürfniss of Militcirisclie Nothwendigkeit d. i. oor-
logsnoodzaak beheerscht het krijgsrecht. De oorlogsnoodzaak is
echter begrensd. Geene beschaafde natie duldt in hare oorlogvoe
rende legers bevelhebbers van den stempel van Alva, Wallenstein
ea Tilly. Art. 11 der bovengenoemde Amerikaansche „Instruc
tions" luidt:
„The law of war does not only disclaim all cruelty and bad faith
concerning engagements concluded with the enemy during the war, but
also the breaking of stipulations solemnly contracted by the belligerents
in time of peace, and avowedly intended to remain in force in case of
war between the contracting powers."
„It disclaims all extortions and other transactions for individual gain;
all acts of private revenge, or connivance at such acts."
„Offences to the contrary shall be severely punished, and especially
so if committed by officers."
Eerst na lezing van het bovenaangehaald artikel kan men de
bedoeling van Bluntschli (die veel uit de door Lieber samengestel
de Amerikaansche „Instructions" heeft geput) in het ondervolgende
begrijpen
„Die Kriegsgewalt darf alles das thun, was die militarische Nothwen
digkeit erfordert und was in Uebereinstimmung ist mit dem allgemeinen
Recht. Im Grunde ist das die entscheidende Hauptregel für das Recht
der Kriegsgewalt. "Was nothwendig sei, ergibt sich nur aus den Urn-
standen. So weit die Nothwendigkeit reicht, so weit reicht die Kriegs
gewalt. Darüber hinaus wird sie rohe Willkür. Freilich ist es nicht
immer leicht, die Grenzen in der Praxis zu bestimmen und es ist un-
möglich hier nach formellen Merkmalen zu verfahren."
Tot hoever de oorlogsnoodzaak mag gaan, leert ons art. 14 der
Amerikaansche „Instructions:"
„Military necessity as understood by modern civilized nations consists
in the necessity of those measures which are indispensable for se
curing the ends of the war, and which are lawful according to the mo
dern 1 aw and usages of war."
Art. 16 der „Instructions" somt de middelen op, waarvan de oor
logsnoodzaak zich nimmer mag bedienen
